THE CAMPUS COMMUNITY
The MBU campus is located in West St. Louis Co. While no guarantee can be made that a person will not be the victim of a crime, the risk factor is moderate to low. Self-protection is a shared responsibility that begins with examining your personal attitudes and practices. This begins with locking your room while you are asleep or away. Most personal crimes occur by way of an unlocked door. If you decide to live off campus, the department will assist you in determining what police jurisdiction you are in, so you may request crime statistics from them.
Throughout the year, the department offers many prevention and informational programs. One program is Public Safety Alert Notice. (These notices are posted around campus within 12 hours of any incident involving personal safety to alert the community of possible problems.) If you have a particular concern or request for other programming, please contact the director.
THE DEPARTMENT
The MBU department of Public Safety provides assistance, protective, and safety services to the campus community. The officers of the department are licensed and have arrest authority through the St. Louis County Police. Each officer is trained and certified at the St. Louis County Police Academy. The Department works with Creve Coeur Department on investigations of crimes on campus.
CRIME STATISTICS
The table below lists the crimes reported to the campus Department of Public Safety for the past five calendar years. The terms and definitions of reported crimes are those used in the Campus Security Act of 1990, with revisions in 1992, 1994 and in 2000.

POLICIES
STUDENT CONDUCT POLICY STATEMENT
Missouri Baptist University is a church-related institution, and it is expected that every employee and every student will conduct himself/herself in accordance with Christian principles both on and off the campus. Personal misconduct either on or off the campus by anyone connected with MBU detracts from the Christian witness the university strives to present to the world and hinders full accomplishment of the university program. While at the University, the student is expected to obey federal, state, and local laws. The student is also expected to obey rules and regulations established by Missouri Baptist University.
In all cases of violation of the University rules and regulations or of actions in violation of local, state, or federal laws which affect the university, Missouri Baptist University reserves the right to proceed with its own disciplinary action independently of governmental charges or prosecution. There is no University policy to wait the outcome of governmental prosecution.
It is the responsibility of the student to become familiar with these policies and rules. The administration will attempt to ensure that all students know the rules through orientation sessions. However, the student is responsible to the University for his/her conduct. If a student should witness a violation of these policies on the part of other students, faculty or administrators, it is his/her responsibility to report it.
In the event that a student violates the campus rules, the student will appear before the Dean of Students and/or the College Conduct Committee for disciplinary action.
SEXUAL HARASSMENT POLICY STATEMENT
Missouri Baptist University is committed to excellence in education that is based on Christian values and standards. The University believes this goal can only be achieved in an environment free of sexual harassment. Sexual harassment undermines the mission of the University and will not be permitted or condoned. The intent of Missouri Baptist University is to provide an environment for students, employees, and faculty that is free from sexual harassment.
Definition
Sexual harassment is the use of personal
power or superiority to intimidate or attempt to intimidate or coerce
a person of the opposite sex (or same sex) into unwanted sexual activity
or to create a hostile or offensive academic or work environment. Sexual
harassment is distinguished from consensual relationships by the introduction
of the element of coercion; threat; unwelcome sexual advances; request
for sexual favors; sexually explicit or suggestive advances; sexually
explicit or suggestive material in written, verbal or visual form; or
other unwelcome verbal or physical conduct of sexual nature where:
- Submission to such conduct is made either explicitly or implicitly a term or condition of the employment or academic performance of the individual.
- Submission to or rejection of such conduct by an individual is used as the basis for academic or employment decisions affecting the individual; or
- Such conduct has the purpose or effect of substantially interfering with academic or work performance of a student or employee, or creating an intimidating, hostile or offensive academic or work environment.
EXAMPLES OF PROHIBITED BEHAVIOR
Prohibited behavior may take various forms. Examples
of conduct that may constitute sexual harassment include, but are not
limited to:
- Unwelcome sexual advances or requests for sexual favors;
- Sexually explicit language, jokes and/or innuendo;
- Repeated sexual propositions, date invitations, solicitations and flirtations, known to be unwelcome;
- Inappropriate and/or offensive touching, fondling, or bodily contact;
- Sexually suggestive objects, pictures, video tapes, audio recordings or literature presented or displayed in the classroom, faculty office, athletic area, residence hall, or common areas;
- Threats or insinuations that may affect a person’s employment, wages, promotional opportunities, grades, evaluations, and other academic or employment performance;
- Sexual assault or attempted sexual assault.
IMPLEMENTATION
To support this policy, Missouri Baptist University
will conduct periodic orientation and educational programs for faculty,
students, and staff concerning sexual harassment in order to insure
a campus environment free from sexual harassment. This orientation
and educational process will be administered by the Dean of Students
Office.
RETALIATION
Retaliation against anyone reporting or thought
to have reported sexual harassment behavior is prohibited. Such retaliation
shall be considered a serious violation of the policy and shall be
considered independent of whether informal or formal complaint of sexual
harassment is substantiated. Encouraging others to retaliate also constitutes
a violation of the policy.
Examples of conduct that may constitute retaliation include, but are not limited to
- unfair grading
- unfair evaluation
- unfair assignments
- having information withheld or made difficult to obtain in a timely manner such as class information, recommendations or grades;
- not being informed about important events, such as meetings or changes in policies;
- ridicule (public or private)
- verbal or written threats or bribes;
- refusal to meet with the person even though that person has a right to do so;
- name calling; and
- further harassment
SEXUAL HARRASSMENT PROCEDURE AND EDUCATIONAL PROGRAM
INFORMAL COMPLAINT
-
At the complainant’s option, a complaint that one or more provisions of this policy have been violated shall be brought in the case of an alleged student violator, to the Dean of Students, and in the case of an alleged faculty violator, to the Academic Dean.
-
The Dean to whom the complaint is made will counsel the complainant as to the options available under this policy and, at the complainant’s request, may intervene on the complainant’s behalf to attempt to resolve the complaint informally through discussions with the person alleged to have violated the policy.
-
The person to whom the informal complaint is made will not inform the accused of the complaint without consent of the complainant.
INVESTIGATION PRIOR TO FORMAL ACTION
-
A complainant wishing to make formal complaint should file a written complaint with the Dean of Students, or Academic Dean, as the case may be, who will determine the method by which the investigation will be conducted.
-
The purpose of the investigation is to establish whether there is a reasonable basis for believing that the alleged violation of this policy has occurred. In conducting the investigation, the appropriate Dean or his/her designee may interview the complainant, the accused, and other persons believed to have pertinent factual knowledge. At all times the Dean is responsible for the investigation.
-
The investigation will afford the accused a full opportunity to respond to the complainants allegations(s).
-
Possible outcomes of the investigation are:
- A judgement that the allegations are not warranted:
- Mutually acceptable resolution of the complaint: or commencement of a formal disciplinary action, described in succeeding sections of the Policy
PROCESS FOR TAKING FORMAL ACTION
-
If, after the investigation is complete, the Dean to whom the complaint is made concludes that there is a reasonable basis for believing that an alleged violation of this policy has occurred and a mutually acceptable resolution of the matter cannot be achieved, formal action may be taken.
-
The decision to take formal action will be made by:
- The Chief Administrative Office for Academic Affairs, currently the Academic Dean, when a faculty member or other instructional personnel has been charged
- The Executive Vice President, when a staff member or employee has been charged: or
- The Chief Administrative Officer in charge of Student Affairs, currently the Dean of Students, when a student has been charged.
FORMAL ACTION
-
Except as specifically modified by other provisions of the Policy, formal action involving allegations of:
- Violations of the Policy by faculty and staff will be governed by the General Faculty Dispute Procedures (See College Personnel Handbook
- Violations of the Policy by students will be governed by the Student Conduct Code. In any hearing held pursuant to this Section, upon motion from one of the parties, made before the start of the hearing process, the hearing panel shall close all of the hearing. Upon motion from one of the parties after the hearing has started or from some other interested party, the hearing panel may close all or part of any hearing held under this procedure.
PERMISSIBLE SANCTIONS FOR VIOLATION OF POLICY
The sanctions for violation of this policy include, but are not limited to, the censure, suspension or termination of employees, faculty and staff of the College, and censure, suspension or expulsion of students.
PROTECTION OF COMPLAINANT AND OTHERS
- Investigations of complaints will be limited only with the complainant’s consent. The complainant will be kept reasonably apprised of the status of the investigation.
- All reasonable actions will be taken to insure the complainant
and those testifying
on behalf of the complainant will suffer
no retaliation as the result of their
participation in the complaint, investigation or hearing process. Steps
to avoid retaliation may include:
- Lateral transfer of one or more of the parties to a different employment setting or a comparable move to a different classroom setting; and/or
- Arrangements that academic and/or employment evaluations concerning the complainant or others may be made by an appropriate individual other than the accused; and/or
- In extraordinary circumstances, the Academic Dean may, at any time during or after an investigation of a sexual harassment complaint, suspend from teaching responsibilities any faculty member or instructional person accused of sexual harassment pending a final hearing, if, after reviewing the allegations and interviewing of the accused, the complainant, and if appropriate, other persons having knowledge of the matter, the Academic Dean finds that it is reasonably certain that (1) the alleged sexual harassment has occurred and (2) serious immediate and irreparable harm will occur if the person continues to teach the class. In the same manner, the Dean of Students may suspend any student alleged to have violated the policy from attending classes and/or otherwise enjoin the student’s presence on campus pending a formal hearing on the charges.
PROTECTION OF THE ACCUSED
-
At the time the investigation commences, the accused will be informed of the nature of the allegations, the identity of the complainant, and the facts surrounding the allegations.
-
In the event a determination is made that there is no reasonable cause to believe the alleged violation to be true, all reasonable steps will be taken to restore the reputation of the accused if it was damaged by the proceedings.
-
A complainant found to have been intentionally dishonest in making the allegations or to have make them maliciously is subject to disciplinary action.
PROTECTING BOTH PARTIES
-
To the extent possible, the proceedings will be conducted in a way calculated to protect the confidentiality of both the complainant and the accused.
-
The parties will be informed promptly about the outcome of the proceedings.
EDUCATION AS A KEY ELEMENT OF THIS POLICY
Educational efforts are essential to the establishment of a campus environment that is as free as possible of sexual harassment.
There are at least four goals to be achieved through education:

Insuring that all faculty members, students, and employees are aware of their right to be free from sexual harassment:
-
Reasonably informing individuals of conduct that is proscribed by the policy;
-
Insuring that administrators properly respond to complaints of violations of this policy;
-
Helping to sensitize students, employees, faculty members and administrators to the issue of sexual harassment on campus.
PREPARATION AND DISSEMINATION OF INFORMATION
-
The office of the Dean of Students is charged with distributing copies of this policy to all current members of the college community and to all those who join the community in the future. An annual letter from the office of the Dean of Students will be sent to all faculty and staff to remind them of the contents of the Sexual harassment Policy. A copy of the sexual harassment Policy will be included in student orientation materials. Copies of this policy will be made continuously available at appropriate Campus centers and offices.

The office of the Dean of Students will develop a series of training sessions for those persons who are likely to receive complaints that this policy has been violated, including but not limited to such persons as residence hall resident assistants, academic advisors, Division Chair, supervisors and faculty.

The Office of the Dean of Students will develop a course designed to inform and educate students to the issue of sexual harassment, the conduct prohibited on campus by this policy and the appropriateness of sanctions for violations of this policy. This course will be mandated for those students determined to have violated the policy and may be imposed as a mandatory component of any complaint resolved through conciliation.
FALSE CHARGES
False charges or complaints of sexual harassment will be treated as a serious offense which is damaging to the total campus community.
HOW TO REPORT A SEXUAL ASSAULT OR RAPE
-
You should tell someone you feel comfortable to talk to.
-
Talk to a counselor.
-
Missouri Baptist Hospital and St. John’s Hospital provide emergency services to victims and are located nearby. They can provide counseling referrals and will contact the police for you.
-
A public safety officer or your R.A. can get help for you anytime. It is not necessary to tell them what happened.
-
Again keep in mind that anyone other than the counselor or nurse must report specific incidents to the police.
REPORTING THE INCIDENT
Choosing whether or not to report the rape or assault is your right and option.
If you are certain you want to report the incident to authorities:
- Contact MBU Public Safety and/or the Creve Coeur Police Department.

ALCOHOLIC BEVERAGES
The consumption and/or possession of alcoholic beverages by students or their guests on campus, at any college-sponsored function or by any group that is identified with the University is prohibited. Any student appearing on campus or at any university-sponsored function under the influence of intoxication beverage will be subject to disciplinary action.
DRUGS
The consumption, possession, and/or use of any narcotic or unlawful drug will be grounds for disciplinary action.
Throughout the year, Missouri Baptist University periodically has information and/or programs concerning the use of abusive substances. If it is deemed that a student has an addictive problem, we will refer him/her to an appropriate program
WEAPONS
Use and possession of firearms, explosive devices or any weapon or device capable of inflicting bodily harm upon a person is strictly prohibited on University property. Violation of this provision is covered by Missouri State law, which imposes severe penalties upon conviction along with a possible jail sentence.
Campus Sex Crimes Prevention Act
Under the Campus Sex Crimes Prevention Act, persons required to register under a state offender registration program must notify the state concerning each post-secondary school at which the offender works or is a student. In Missouri, sex offenders must register with the police department in the city or county in which they live or work. Currently the State of Missouri does not provide a registered sex offender internet site or compilation, however St. Louis County does have an internet listing of offenders that are registered with their department.
